NPA successfully opposes bail for Makhanda Correctional official accused of murder plot

Makhanda– The Eastern Cape National Prosecuting Authority (EC NPA) has successfully opposed the bail application of a Makhanda-based correctional services official accused of plotting to murder managers at the facility where he works.

Viwe Stemela (47) appeared before the Makhanda Magistrate’s Court, where the court ruled that granting bail would not be in the interests of justice.

State Prosecutor Sicelo Magcina led evidence from the investigating officer, outlining the seriousness of the charges and the strength of the State’s case.

Stemela faces a charge of conspiracy to commit murder. The prosecution argued that Stemela’s position within the correctional services environment placed him in a position of authority and influence.

According to the State, he is familiar with the identities of potential witnesses creating a significant risk of interference should he be released on bail.

The court heard that bail conditions would not adequately mitigate this risk, given the accused’s access and influence within the correctional environment.

The prosecution further stressed that the gravity of the allegations and the surrounding circumstances warranted his continued detention.

The court agreed with the State’s submissions and denied bail. Stemela was arrested following an investigation conducted by the Directorate for Priority Crime Investigation (DPCI), also known as the Hawks.

In addition the matter has been postponed to 16 March 2026 to allow for further investigation.

Welcoming the court’s decision, the NPA reiterated its commitment to ensuring that serious crimes particularly those involving threats to life and alleged abuse of positions of trust are dealt with decisively in the interests of justice.
