GQEBERHA- The Gqeberha Regional Court has handed down a life sentence to 47 year old Mxolisi Gladman Hina for the brutal rape of a 40 year old woman in Missionvale on 03 September 2017.
The sentencing took place in Gqeberha on the 31st of October 2024.
This conviction not only reflects the court’s resolve to combat sexual violence but also marks another chapter in Hina’s disturbing criminal history, as he was already serving an 18 year sentence for a similar offense committed in 2010.
According to the statement issued by the Eastern Cape National Prosecuting Authority(NPA), “The harrowing incident unfolded when the victim was lured to Hina’s residence by a supposed friend, who feigned an invitation for drinks.” Once alone with Hina, she was violently assaulted, escaping only to seek refuge with a neighbor.
The resilience of the victim shone through as she ultimately decided to testify despite the immense fear and trauma she faced.
The case was fraught with challenges, including the disappearance of the crucial witness her friend who faced community backlash and had to go into hiding.
In addition provincial NPA Spokesperson Luxolo Tyali said, “However, with the unwavering support of the police and community members, she was located and bravely testified in court, playing a vital role in bringing Hina to justice.”
State prosecutor Wonga Jita, who led the prosecution for both of Hina’s convictions, presented compelling evidence that highlighted Hina’s pattern of predatory behavior.
‘He poses a serious threat to society,’ Jita argued, advocating for a life sentence to prevent future horrors.
The court agreed, also mandating that Hina’s name be added to the National Register for Sex Offenders, ensuring that his actions have lasting consequences.
Furthermore Eastern Cape Director of Public Prosecutions Barry Madolo, lauded the courage of the complainant and the tireless efforts of the prosecution and support teams stating, “This life sentence sends a strong message that there is zero tolerance for repeat offenders.”
Court Preparation Officer(CPO) Yolanda Matiti played a crucial role in securing justice for a rape survivor, whose case was plagued by delays.
Matiti’s dedication helped the survivor overcome health concerns and mistrust in the justice system.
